These Terms of Sale apply to purchases from the elenix online store, operated by Elenix ("elenix," "we," "us," or "our"). By placing an order, you agree to these Terms of Sale, our Terms of Use, and our Website Privacy Policy. If these Terms of Sale and the Terms of Use conflict about a purchase, these Terms of Sale control.
1. What we sell
The elenix store sells stationery and paper goods, including mental health-inspired journal inserts. Products are for general personal use and reflection.
Store products do not constitute, replace, or indicate medical, psychological, psychiatric, or clinical advice. They are not therapy, assessment, diagnosis, or treatment, and they do not guarantee any particular result. More detail is in our Disclaimer.
2. No provider-client relationship
In psychotherapy, the words "client" and "patient" mean the same thing. Buying, receiving, or using a product does not create a provider-client or provider-patient relationship and does not give you access to clinical advice or communication with Kristina Netherton.
If you are a current or former elenix client, buying from the store is never required or recommended as part of your treatment and has no effect on your care, scheduling, or fees. Store orders are handled as ordinary retail purchases and are kept separate from clinical records. Payments for psychotherapy services are not made through the store.
3. Eligibility
You must be at least 18 years old to place an order.
4. Orders
Your order is an offer to buy. We accept your order when we ship it. We may decline or cancel an order, including for suspected fraud, an error in price or product description, or items that are no longer available. If we cancel an order you have paid for, we will refund you in full.
To cancel your own order, email support@elenix.health as soon as possible. If the order has not shipped, we will cancel it and refund you in full. Once an order has shipped, the return policy in Section 8 applies.
5. Prices, sales tax, and discounts
Prices are listed in U.S. dollars. Applicable sales tax is calculated at checkout based on your shipping address. Shipping charges and your order total are shown before you complete your purchase.
Discount codes are limited to one per order unless stated otherwise, have no cash value, and cannot be applied to past orders.
6. Payment
Payment is processed at checkout by the payment processor connected to our Squarespace store. We do not receive or store your full card number. Your payment is charged when you place your order.
7. Shipping
We ship to addresses in the United States only.
Orders usually ship within 1–3 business days. Delivery times after shipment depend on the carrier and shipping method selected at checkout. You will receive an email with tracking information when your order ships.
If we cannot ship your order within the time stated, we will notify you by email with a revised shipping date and give you the option to cancel your order for a full and prompt refund.
Please make sure your shipping address is correct. If a package is returned to us because of an incorrect or incomplete address, we will contact you to arrange reshipment at your cost or to refund the order, less original shipping charges.
Risk of loss passes to you when we deliver your order to the carrier. We are not responsible for packages that are lost, stolen, or delayed after that point, including packages marked as delivered. If this happens, contact us and we will give you the tracking and shipping details you need to file a claim with the carrier.
8. Returns and refunds
30-day returns. You may return unused items in their original packaging within 30 days after delivery.
•To start a return, email support@elenix.health with your order number and the items you are returning. We will reply with return instructions.
•You are responsible for the cost of return shipping, and original shipping charges are not refunded, unless the return is because of our error (see below).
•Items that have been written in, used, or damaged after delivery cannot be returned.
•Once we receive and inspect your return, we will refund the item price and any sales tax charged on it to your original payment method within 5 business days. Your bank or card issuer may take additional time to post the refund.
Damaged or incorrect items. If an item arrives damaged or we sent the wrong item, email support@elenix.health within 3 days after delivery with your order number and a photo of the item and packaging. We will send a replacement or a full refund, including original shipping charges, at no cost to you. You will not need to pay to return the item.
Defective items. If an item has a manufacturing defect, such as faulty binding or printing, contact us at support@elenix.health and we will address it as required by law.
9. Personal use and intellectual property
Buying a product gives you ownership of that physical item for your personal use. It does not give you the right to copy, scan, reproduce, share, sell, or distribute its designs or content, or to use them to provide services to others, without our prior written consent. Product designs and content are protected as described in our Terms of Use.
10. Product information
We try to describe and photograph products accurately. Colors, paper texture, and print details may vary slightly from what appears on your screen.
11. Your rights under law
Nothing in these Terms of Sale limits any rights you have under consumer protection laws that cannot be waived or limited by agreement.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR PRODUCTS GIVING RISE TO THE CLAIM. Some laws do not allow certain limitations, so parts of this section may not apply to you.
13. Disputes
If you have a problem with an order, please contact us first so we can try to resolve it. Any dispute about a purchase is governed by the informal dispute resolution, arbitration, class action waiver, and governing law sections of our Terms of Use.
14. Changes to these Terms of Sale
We may update these Terms of Sale from time to time. Updated Terms of Sale will be posted on this page with a new "Last updated" date. The Terms of Sale in effect when you place an order apply to that order.
